Standard Conditions of Carriage for
General Motor Vehicle Transportation

(Scope of Application)
  • Article 1 (1) Contracts of carriage relating to general Passenger automobile transportation services operated by this Company shall be governed by these Conditions of Carriage, and any matter not provided for in these Conditions of Carriage shall be governed by the laws and regulations of Japan or by general custom.
  • (2) If this Company agrees to any special contract with respect to any provision of these Conditions of Carriage to the extent that it is not in conflict with the purpose of these Conditions of Carriage and laws and regulations, such special contract shall apply notwithstanding the provisions of this special contract.
(Instructions from Staff Members)
Article 2 Passengers must comply with the instructions given by our drivers and other staff members in the course of their duties to ensure the safety of Carriage.
(Acceptance of Carriage)
Article 3 This Company will accept the Carriage of Passengers, except in cases where we refuse to accept or continue the Carriage in accordance with the provisions of the following article or Article 4-2.
(Refusal or Limitation of Carriage)
  • Article 4 We may refuse to accept or continue Carriage in any of the following cases.
    1. When the application for Carriage is not in accordance with these terms and conditions.
    2. When there are no facilities suitable to carry out Carriage.
    3. When the applicant requests a special provision in relation to the Carriage.
    4. When the Carriage is contrary to the provisions of the laws and regulations of Japan, to the public order, or to good morals.
    5. When there is an impediment to Carriage due to a natural disaster or other unavoidable event.
    6. When a Passenger does not comply with measures taken by the driver in accordance with the provisions of the Passenger Vehicle Transportation Business Transportation Regulations.
    7. When a Passenger is carrying a weapon or other object prohibited from being brought on board in accordance with the provisions of the Passenger Vehicle Transportation Business Transportation Regulations.
    8. When a Passenger is carrying an object that is prohibited from being brought on board in accordance with the provisions of Article 4-3, Paragraphs 3 or 4.
    9. When a Passenger is at a level of intoxication to the point that he/she cannot clearly state his/her destination or has difficulty walking without assistance.
    10. When a Passenger is wearing dirty clothing that may contaminate the interior of the vehicle.
    11. When a Passenger is seriously ill and not accompanied by a care taker.
    12. A Passenger is a patient (including a person deemed to be such a patient) of a Class I infectious disease, Class II infectious disease, new influenza or other infectious disease or designated infectious disease (limited to those requiring hospitalization) under the Act on Prevention of Infectious Diseases and Medical Care for Patients Suffering from Infectious Diseases, or a person who shows symptoms of a new infectious disease.
    • Article 4-2 Passengers shall refrain from smoking in this Company’s non-smoking vehicles (meaning vehicles marked as “Non-Smoking Vehicles”; the same shall apply in the following paragraph).
    • If a Passenger smokes or attempts to smoke in any of this Company’s non-smoking vehicles, the driver may request the Passenger to stop smoking, and if the Passenger fails to comply with such a request, this Company may refuse to accept or continue Carriage of the Passenger.
(Restrictions on Personal Articles)
  • Article 4-3 Passengers may not bring on board the items specified in Article 4 subsection 7.
  • (2) If we suspect that a Passenger's personal items (meaning items carried by the Passenger; the same applies below) may contain items specified in the previous paragraph, we may request the Passenger to clearly state the contents of said personal items.
  • (3) If a Passenger does not comply with a request under the provisions of the previous paragraph, we may refuse to allow the Passenger to carry on the personal items.
  • (4) If a Passenger complies with a request under the provisions of paragraph 2, but the contents of the personal items are similar to and difficult to distinguish from the items specified in paragraph 1, we may refuse to allow the Passenger to carry on the personal items, unless the Passenger provides reasonable proof that they are not such items.
(Fares and Charges)
  • Article 5 The fares and charges collected by this Company shall be those approved by the Director of the Regional Transport Bureau at the time of the Passenger’s boarding, or those implemented after notification to the Director of the Regional Transport Bureau.
  • (2) The fares and charges in the preceding paragraph shall be those displayed on the fare and charge meter, except in cases where an hourly rental contract has been made.
(Collection of Fares and Charges)
Article 6 This Company requires Passengers to pay fares and charges when they disembark.
(Liability to Passengers)
    • Article 7 If the operation of our vehicle causes injury to the life or body of a Passenger, this Company shall be liable to compensate for damages resulting therefrom. However, this shall not apply if we prove that we and our staff did not neglect to exercise caution in the operation of the vehicle, that there was no intent or negligence on the part of the Passenger or a third party other than our staff, and that the vehicle had no structural defects or functional impairments.
    • (2) In the case of the preceding paragraph, our liability to Passengers begins when the Passenger boards the vehicle and ends when the Passenger disembarks.
  • Article 8 In addition to the provisions of the preceding article, our Company shall be liable to compensate Passengers for any damages incurred in relation to the Carriage. However, this shall not apply if we can prove that this Company and our staff did not neglect to exercise due care in relation to the Carriage.
  • Article 9 If we temporarily suspend operations or take other measures to ensure Carriage safety due to a natural disaster or other cause beyond our control, we shall not be liable to compensate Passengers for any damages suffered as a result.
(Passenger Liability)
Article 10 If this Company incurs damage due to a Passenger's intentional or negligent act, or due to the Passenger's failure to comply with laws and regulations or the provisions of these terms and conditions of Carriage, the Company will seek compensation for such damage from the Passenger.
